HPS&R, Inc, Case No. 7:99-CV-222-BR(1) (E.D.N.C.), was lodged with the United States District Court for the Eastern District of North Carolina on November 22, 1999. The proposed Consent Decree concerns alleged violations of sections 301(a) and 404 of the Clean Water Act, 33 U.S.C. 1311(a) and 1344, resulting from Defendant's unauthorized discharge of dredged and/or fill material into waters of the United States at the Phillips-Sabiston Estate in Onslow County, North Carolina. The proposed Consent Decree would require the payment of a civil penalty of $85,000 and preservation of 100 acres of wetlands as a supplemental environmental project. The United States Department of Justice will receive written comments relating to the proposed Consent Decree for a period of thirty (30) days from the date of publication of this notice.
