MATTERS TO BE CONSIDERED: The Commission will consider and act upon the 
following:
    1. Martin Marietta Aggregates, Docket No. SE 98-156-M (Issues 
include whether the judge erred in finding that a miner's negligence 
was not imputable to the operator for penalty assessment and 
unwarrantable failure purposes because the miner was not an agent of 
the operator.)
    Any person attending an open meeting who requires special 
accessibility features and/or auxiliary aids, such as sign language 
interpreters, must inform the Commission in advance
