AT&T Corp., AT&T of the Virgin Islands, A&L Underground, Inc., and BioImpact, Inc., Civil Action No. 2000-42, was lodged with the United States District Court for the District of the Virgin Islands on March 9, 2000. This is a civil enforcement action stating claims against AT&T Corp., AT&T of the Virgin Islands, A&L Underground, Inc., and BioImpact, Inc for violations of the Rivers and Harbors Act (``RHA''), 33 U.S.C. 401 et seq., and the Clean Water Act (``CWA''), 33 U.S.C. 1251 et seq., in connection with the Defendants' construction of a transoceanic cable landing facility in St. Croix, the U.S. Virgin Islands. The proposed Consent Decree would resolve these violations and, among other provisions, would require Defendants to (1) pay a civil penalty in the amount of $1.8 million, and (2) conduct further monitoring of the areas where drilling mud was released, to ensure that any remaining drilling mud is discovered and removed. The Department of Justice will accept written comments relating to the proposed Consent Decree for thirty (30) days from the date of publication of this notice.
