Johnson, No. 07-0612 (D. N.J.). On July 21, 2006, NJDEP filed a deadline suit to compel the Administrator to respond to a petition seeking EPA's objection to the issuance of a revised CAA Title V operating permit to Reliant Energy Mid-Atlantic Power Holdings LLC for its Portland Generating Station in Pennsylvania. Under the terms of the proposed settlement agreement, EPA has agreed to respond to NJDEP's petition by June 20, 2007. Additional Information About the Proposed Settlement Agreement NJDEP submitted a petition to the Administrator of the Environmental Protection Agency pursuant to CAA section 505(b)(2), requesting that he object to issuance of a Title V operating permit to Reliant Energy Mid-Atlantic Power Holdings LLC for its Portland Generating Station in Pennsylvania. Under the terms of the proposed settlement agreement, EPA shall grant or deny NJDEP's petition no later than June 20, 2007, and NJDEP shall dismiss its complaint with prejudice. The Court will retain jurisdiction to resolve any claim for the costs of litigation (including attorneys' fees). For a period of thirty (30) days following the date of publication of this notice, the Agency will receive written comments relating to the proposed settlement agreement from persons who were not named as parties or intervenors to the litigation in question. EPA or the Department of Justice may withdraw or withhold consent to the proposed settlement agreement if the comments disclose facts or considerations that indicate that such consent is inappropriate, improper, inadequate, or inconsistent with the requirements of the Act. Unless EPA or the Department of Justice determines, based on any comment which may be submitted, that consent to the settlement agreement should be withdrawn, the terms of the settlement will be affirmed.
